BackgroundIn this manuscript, we argue that within the context of phase IV, physician-researchers retain their fiduciary obligation to treat the patient-participants.DiscussionWe first clarify why the perspective that research ethics ought to be differentiated from clinical ethics is not applicable in phase IV, and therefore, why therapeutic orientation is most convivial in this phase. Next, assuming that ethics guidelines may be representative of common morality, we show that ethics guidelines see physician-researchers primarily as physicians and only secondarily as researchers. We then (...) elaborate on what a fiduciary obligation is and how some of the obligations are default duties. Lastly, we look at the fiduciary obligation of the physician-researcher in phase IV interventional trials.ConclusionThe fiduciary obligation to treat is not as easily waived as in earlier trials. Assuming the entwinement of research and practice in phase IV, physician-researchers, in collaboration with other researchers, investigators, and research ethics committees, should ensure that in terms of study design, methodology, and research practice, the therapeutic value of the research to the patient-participants is not diminished. Within current debates about the future impact of Artificial Intelligence on human society, roughly three different perspectives can be recognised: the technology-centric perspective, claiming that AI will soon outperform humankind in all areas, and that the primary threat for humankind is superintelligence; the human-centric perspective, claiming that humans will always remain superior to AI when it comes to social and societal aspects, and that the main threat of AI is that humankind’s social nature is overlooked in technological designs; and the (...) collective intelligence-centric perspective, claiming that true intelligence lies in the collective of intelligent agents, both human and artificial, and that the main threat for humankind is that technological designs create problems at the collective, systemic level that are hard to oversee and control. The current paper offers the following contributions: a clear description for each of the three perspectives, along with their history and background; an analysis and interpretation of current applications of AI in human society according to each of the three perspectives, thereby disentangling miscommunication in the debate concerning threats of AI; and a new integrated and comprehensive research design framework that addresses all aspects of the above three perspectives, and includes principles that support developers to reflect and anticipate upon potential effects of AI in society. BackgroundThe Netherlands is one of the few countries where euthanasia is legal under strict conditions. This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain.MethodsWe did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis.ResultsOf the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of the law, mostly relating to (...) the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable.ConclusionsOf the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

BackgroundResearch ethics committees (RECs) are tasked to assess the risks and the benefits of a trial. Currently, two procedure-level approaches are predominant, the Net Risk Test and the Component Analysis.DiscussionBy looking at decision studies, we see that both procedure-level approaches conflate the various risk-benefit tasks, i.e., risk-benefit assessment, risk-benefit evaluation, risk treatment, and decision making. This conflation makes the RECs’ risk-benefit task confusing, if not impossible. We further realize that RECs are not meant to do all the risk-benefit tasks; instead, (...) RECs are meant to evaluate risks and benefits, appraise risk treatment suggestions, and make the final decision.ConclusionAs such, research ethics would benefit from looking beyond the procedure-level approaches and allowing disciplines like decision studies to be involved in the discourse on RECs’ risk-benefit task. In this paper, I would argue for a mindful sports philosophy that stresses that wisdom does not emerge from abstract thinking; instead, it requires that we become attentive to what is concrete: our everyday life and how we spend it. Do we spend our life wisely or not? Answering this question requires that we know ourselves sufficiently — that is to say, have we explored and examined our own life by paying attention to it while we are living it? Am (...) I aware of how my life constantly intervenes with life in general and vice versa? To exemplify this philosophical approach, I will refer to examples from mod- ern football coaching that illustrate how they play themselves and their team into certain thoughts, not the other way around. However, a crucialю part of coaching and leading in sports relies on self-knowledge, not as something that only emerges from the inside out but equally from how the outside affects us. In this paper, I will argue how a mindful sports philosophy understands self-knowl- edge as both an introspection and “interiosation” of the outside with the quest of becoming worthy of what happens. The aim of the present study is (1) to show, on the basis of a number of unpublished documents, how Heinrich Scholz supported his Warsaw colleague Jan Łukasiewicz, the Polish logician, during World War II, and (2) to discuss the efforts he made in order to enable Jan Łukasiewicz and his wife Regina to move from Warsaw to Münster under life-threatening circumstances. In the first section, we explain how Scholz provided financial help to Łukasiewicz, and we also adduce evidence of (...) the risks incurred by German scholars who offered assistance to their Polish colleagues. In the second section, we discuss the dramatic circumstances surrounding the Łukasiewiczes' move to Münster in the summer of 1944. (shrink)

The bulk of the present book has not been published previously though Chapters II and IV are based in part on two earlier papers of mine: "The Influence of Harald H!1lffding's Philosophy on Niels Bohr's Interpretation of Quantum Mechanics", which appeared in Danish Yearbook of Philosophy, 1979, and "The Bohr-H!1lffding Relationship Reconsidered", published in Studies in History and Philosophy of Science, 1988. These two papers comple ment each other, and in order to give the whole issue a more extended treatment (...) I have sought, in the present volume by drawing on relevant historical material, to substantiate the claim that H!1lffding was Bohr's mentor. Besides containing a detailed account of Bohr's philosophy, the book, at the same time, serves the purpose of making H!1lffding' s ideas and historical significance better known to a non-Danish readership. During my work on this book I have consulted the Royal Danish Library; the National Archive of Denmark and the Niels Bohr Archive, Copenhagen, in search of relevant material. I am grateful for permission to use and quote material from these sources. ZusammenfassungMedizinethische Forschung wird häufig unter Verwendung sozialempirischer Methoden durchgeführt. Insbesondere die Anwendung von Methoden der qualitativen Sozialforschung hat eine breite Akzeptanz gefunden. Nach Kenntnis der Autoren fehlen allerdings bislang Untersuchungen, die den spezifischen Beitrag qualitativer Sozialforschung für medizinethische Untersuchungen unter Bezugnahme auf die Merkmale qualitativer Methoden darlegen. Ausgehend von einem handlungsorientierenden medizinethischen Forschungsvorhaben zur Unterstützung der Entscheidungsfindung in der Onkologie wird der Beitrag der verwendeten qualitativen Methoden für das Forschungsvorhaben unter Bezugnahme auf zwei Kennzeichen qualitativer Sozialforschung – Rekonstruktion der sozialen (...) Praxis und Explikation von informellem Wissen – ausgeführt. Den Abschluss bilden eine Analyse von Limitationen der Verwendung qualitativer Forschungsmethoden in medizinethischen Forschungsvorhaben sowie die Identifizierung offener Forschungsfragen. (shrink)

The concept of intentionality was founded when philosophers attempted to describe (...) and solve the philosophical problem of specific „quasi-relations" between consciousness and objects and the direction of our mind or language to the real world. Der Beitrag empirischer Forschung zur Bearbeitung medizinethischer Fragestellungen ist Gegenstand eines aktuellen interdisziplinären Diskurses. Während die Anzahl empirischer Studien, die in medizinethisch relevanten Fachzeitschriften publiziert wurden, in den letzten Jahren zugenommen hat, liegen nach Kenntnis der Autoren kaum methodenreflexive Veröffentlichungen zu konkreten empirischen Forschungsprojekten in der Medizinethik vor. Die Untersuchung der Wechselbeziehungen von Ethik und Empirie anhand ausgewählter interdisziplinärer empirisch medizinethischer Forschungsprojekte erscheint aus mehreren Gründen von Interesse. Zum einen kann auf diese Weise der mögliche Beitrag empirischer Forschung zur Bearbeitung (...) medizinethischer Fragestellungen exemplarisch analysiert werden. Zum anderen lassen sich auf diese Weise methodische wie auch forschungspraktische Herausforderungen bei der Planung, Durchführung und Auswertung empirischer Untersuchungen in der Medizinethik beschreiben und mögliche Lösungswege aufzeigen. In diesem Beitrag werden methodische Herausforderungen bei der Anwendung sozialempirischer Methoden im Rahmen eines interdisziplinären medizinethischen Forschungsprojekts zur ärztlichen Handlungspraxis am Lebensende dargestellt und analysiert. A polynomial time ultrapower is a structure given by the set of polynomial time computable functions modulo some ultrafilter. They model the universal theory \ of all polynomial time functions. Generalizing a theorem of Hirschfeld :111–126, 1975), we show that every countable model of \ is isomorphic to an existentially closed substructure of a polynomial time ultrapower. Moreover, one can take a substructure of a special form, namely a limit polynomial time ultrapower in the classical sense of Keisler Ultrafilters across (...) mathematics, contemporary mathematics vol 530, pp 163–179. AMS, New York, 1963). Using a polynomial time ultrapower over a nonstandard Herbrand saturated model of \ we show that \ is consistent with a formal statement of a polynomial size circuit lower bound for a polynomial time computable function. This improves upon a recent result of Krajíček and Oliveira, 2017). (shrink)

The application of probabilistic arguments to rational decisions in a single case is a contentious philosophical issue which arises in various contexts. Some authors (e.g. Horgan, Philos Pap 24:209–222, 1995; Levy, Synthese 158:139–151, 2007) affirm the normative force of probabilistic arguments in single cases while others (Baumann, Am Philos Q 42:71–79, 2005; Synthese 162:265–273, 2008) deny it. I demonstrate that both sides do not give convincing arguments for their case and propose a new account of the relationship between probabilistic reasoning (...) and rational decisions. In particular, I elaborate a flaw in Baumann’s reductio of rational single-case decisions in a modified Monty Hall Problem. (shrink)

Martin Heidegger was convinced that we can learn something about the way we inhabit the world by turning attention to our fundamental moods. It was one important theme of his fundamental ontology in the 1920s. There is, according to Heidegger, an intricate connection between awakening our moods and developing a reflexive stance. He provides us with a rich phenomenological description of different forms of boredom. In this article I approach Heidegger’s conception of boredom from an educational point of view. I (...) am suggesting a reading where the experience of boredom has transformative potentialities that also can illuminate our cultural situation as a whole. By turning away from boredom there is always a possibility of turning away from ourselves. (shrink)

The central topic of this article is (the possibility of) de re knowledge about natural numbers and its relation with names for numbers. It is held by several prominent philosophers that (Peano) numerals are eligible for existential quantification in epistemic contexts (‘canonical’), whereas other names for natural numbers are not. In other words, (Peano) numerals are intimately linked with de re knowledge about natural numbers, whereas the other names for natural numbers are not. Dieser Band versammelt originäre Beiträge am Schnittpunkt von Philosophie, Wissenschaftsgeschichte, Kultur- und Theaterwissenschaft. Auf der Grundlage von Falluntersuchungen zum 17. Jahrhundert trägt er zum Verständnis der Rolle bei, die wissenschaftliche Instrumente im Schnittfeld von Wissenschaft und Kunst spielen. Die Beiträge verfolgen dabei die Hypothese, dass die Entwicklung und Gestaltung von Instrumenten wesentlich zur Eröffnung neuer Felder des Wissens, zur Entstehung neuer kultureller Praktiken, aber auch zur Abgrenzung bestimmter Genres, Methoden und Disziplinen beiträgt.

ZusammenfassungEntscheidungen am Lebensende sind Bestandteil der ärztlichen Tätigkeit. In dieser Studie wurden Berliner Medizinstudierende zu ihren Kenntnissen der rechtlichen Grundlagen und ihrer ethischen Bewertung von passiver und aktiver Sterbehilfe befragt. Im Wintersemester 2002/2003 wurde eine schriftliche Befragung zu ethischen und rechtlichen Aspekten der Sterbehilfe unter den Teilnehmenden eines Pflichtkurses für Medizinstudierende im fünften Studienjahr an der Charité, Universitätsmedizin Berlin durchgeführt. Gruppenunterschiede im Antwortverhalten wurden mit dem χ2-Test nach Pearson geprüft. Von 102 Studierenden beantworteten 85 den Fragebogen (Rücklaufquote = 82,5%). Es (...) wussten 46 Medizinstudierende (54,1%), dass die Therapiebegrenzung am Lebensende legal sein kann; 70 (82,3%) hielten dies für ethisch akzeptabel. Die Tötung auf Verlangen in bestimmten Situationen hielten 35 Studierende (41,2%) für ethisch akzeptabel; 28 (33,0%) befürworteten die Legalisierung der Tötung auf Verlangen in bestimmten Situationen. Im Vergleich zu Ärztinnen und Ärzten in Deutschland wurde die Tötung auf Verlangen von weniger Studierenden abgelehnt. Angesichts der bestehenden Unsicherheiten bei den Studierenden hinsichtlich der rechtlichen und ethischen Bewertung von Entscheidungen am Lebensende sollten diese Aspekte in der medizinischen Ausbildung stärker berücksichtigt werden. The general purpose of this book differs from those of most of the works found traditionally in the field of political philosophy. Firstly, the present approach is in no way prescriptive or normative, as the interest centres on explication rather than an evaluative assess ment of this, that or another type of arrangement, or act. 1 It will be clear that I am in complete disagreement with Gewirth when he claims that "The central concern of political philosophy is the moral (...) evaluation of political power. " It seems obvious that the under standing of political and social forms of life, and a fortiori of political power, must come before its evaluation. This cannot be provided by moral assessment alone. Thus an analytical or explicative approach which promotes such understanding must come first, and must be the "central concern" of the appropriate philosophical discipline. This is not to say that moral assessment is illegitimate, nor even that it cannot be one of the concerns of political philosophy, but it is to deny that it can be central, even though it might be somebody's central interest. To the extent to which this book is successful it will provide an argu mentin my favour - if the job can be done, obviously it is of primary importance. But we should not assume that it cannot be done unless we can show that there is no separate sphere of political and/or social phenomena. (shrink)

In this article I am dealing mainly with the following notions: “perception apparatus” (Weltbildapparat), “view of the world” (Weltbild, picture of the world) and “representation”. The first and the second ones belong to the basic notions in the vocabulary of K. Lorenz’s evolutionary epistemology, the third in cognitive sciences. I seek to demonstrate the relationships between them. This analysis is put in a broader context, indicating the relationships between expensively developing cognitive sciences and evolutionary epistemology (much less popular today). It (...) is quite easy to determine what the perception apparatus is, however, it is harder to state what the view of the world, especially in its ontological aspect, is. Nevertheless, the view of the representation in the context of evolutionary epistemology points to the fact that this notion is still unclear and many representational features can be assigned to objects which, as it seems, are not representations according to cognitive sciences. Moralische Überzeugungen werden in ähnlicher Weise gebildet und gerechtfertigt wie nicht-moralische. Daher können Erkenntnisse über epistemische Rechtfertigung auch helfen, ethische Rechtfertigung zu erklären. Ethische Rechtfertigung wird als der Versuch verstanden, in moralischen Fragen richtige Antworten zu finden, also moralische Erkenntnis zu gewinnen. The general thrust of Neil Levy's paper is that a certain amount of paternalism should be viewed as compatible with liberalism.1 I am not quite convinced that what he is defending is properly paternalism. In addition, I am not entirely sure what his proposal is. Here are a few comments about several points in the paper.1. A possibly small question is worth raising when Levy says, ‘That is, the state may not interfere with individuals’ actions, even to promote their own (...) conception of the good. This claim is typically justified on epistemic grounds: individuals are best placed to judge for themselves how to pursue their conception of the good.’But I don't think that this is quite the right picture, though admittedly, it has often been suggested by liberals. Still: if it's a matter of ‘epistemic’ grounds, then that implies that there is something out there to be known, so that the question is, how do we go about knowing it? But this way of putting it is misleading. For liberalism says that whenever anybody, B, other than the individual we are considering, say A, claims that what is good for A is something ‘out there’—something that can strongly contradict what A thinks for his own case—then that outsider has no authority to override A's preference. This isn't epistemic—it's a moral position.If we were to talk of ‘epistemic’ here, presumably what is known in this case is how the individual …. (shrink)

My main complaint about Dworkin's papers on equality was that he had not said much by way of arguing for it. His intriguing response to this request provides a good start, and I shall confine this brief, further comment to what he says on that basic subject. Space considerations, alas, require me to ignore the other parts of his discussion. Dworkin distinguishes what he calls the “abstract egalitarian thesis” from his particular version of equalitarianism, equality of resources. His strategy is (...) to argue, first, that the latter is the best realization or version of the former, and then to argue for the general thesis itself. In my comments, I shall reverse this order, however, for reasons that will be clear as we proceed. 1. TheEgalitarian Thesis Dworkin states this as follows: “From the standpoint of politics, the interests of the members of the community matter, and matter equally.” The statement is intended to be abstract in the sense that it would “embrace various competing conceptions of equality,” so that in principle we can divide the discussion the way Dworkin has done into the two questions, “Should we accept equality as a principle at all?” and “What is the best version of equality, at what we might call the constitutional level?” But can we really do this? I am not entirely clear that we can. In order to appreciate the difficulty here, at any rate, consider Dworkin's suggestion that ”in order to sharpen the question” – the question whether to accept equality as a principle at all, that is –“I ask you to suppose that the abstract egalitarian principle does provide a good argument for subsidized medicine…” Now, some might think that such a program is paradigm case of what ought to be rejected at the public level, and yet his reasons for such rejection might very well be based on a principle that its proponent would regard as abstractly egalitarian. The topic of the article is the distinction between descriptions of facts and their evaluation. This distinction is of interest to both in philosophy and in the theory of journalism. The article considers one of the assumptions supporting the view that journalists should clearly separate descriptions of facts from their assessment - the assumption that descriptions of facts can be separated from their evaluation. I present various interpretations of this assumption. I point out the existence of a relationship between the (...) thesis of the possibility of separating descriptions from assessments and the belief that descriptions of facts are by their very nature objective, while assessments or valuations are subjective, and then I proceed to criticize the latter conviction. These arguments are not intended to undermine the distinction between descriptions of facts and their evaluation. What I am trying to undermine are the metaphysical justifications and interpretations of this distinction. (shrink)

There is only one “race”: the human race; to think otherwise is like still believing that the earth is flat. But “racism” is a different matter. It exists as a system of beliefs and prejudices that people differ along biological and genetic lines and (...) that one’s own group is superior to another group. When these beliefs and prejudices are coupled with power—especially the power to negatively affect the lives of those perceived to be inferior—we have a serious problem. And no one should downplay or underestimate the harm that such an ideology inflicts upon everyone who participates in it. According to one African American professor of social work, “America’s history is inextricably bound to this racist ideology. From the codifying of slavery, to the belief in ‘Manifest Destiny,’ to the treatment of ‘illegal immigrants,’ many of America’s actions continue to conflict with its creed that ‘All men are created equal.’”1Over the past decade or so, I have written a number of pieces that focus upon racism in America and racism in so-called American Buddhism.2 Being African American myself, my reasons for this focus may perhaps be clear though not necessarily inevitable. I have written on a number of other topics: Buddhist philosophical discourses and life stories of Buddhist “saints,” for example. In my writings on racism, I have tried to communicate something of the emotional and psychic toll it takes to live in this country as a person of color. In a number of these writings, I have called myself a “Baptist-Buddhist,” and thus this is also one of my “dual belongings,” one of my “multiple identities.”When I speak of racism, I am not concerned with garnering pity, or playing the “race card” of guilt, or telling you, from some assumed position of superiority on the matter, that there is simply no way for you to understand this toll. I certainly cannot speak for all African Americans, or even for most of them. Early on in the process of writing this paper, I emailed Jung and Paul to say that I found the title of the panel both much too broad and much too narrow. “Too broad” because one person cannot possibly channel and/or verbalize the countless instances of suffering endured by African Americans (and more broadly, by persons of color) throughout space and over centuries in this country owing to slavery and its aftermath. And “too narrow” [End Page 97] because, ultimately, we want to do more than just rehash our many sufferings. We don’t want to wallow in victimhood. We want to move on—from the recognition of that immense suffering, seen and unseen—and to go out into the world and act to bring about social, economic, and ecological justice. That’s what we are called upon to do: to form a new community wherein there is compassion and caring for one another, where there is love and peace, nonviolence, reconciliation, and justice.So, even though I am quite frankly tired—as are so many people of color—of being the “token” African American who can add visible “diversity” to a group in order to show that it is now more “inclusive” than before, nevertheless, in this so-called postracial society where we have a black president and the demographic of “person of color” now comprises an actual majority of the United States’ population, I must still rise to say that, sadly, racism is not dead in this country! Oogenesis being performed in the ovary shows two different kinds of nuclei in the nursing cells. The above mentioned nuclei are transferred and incorporated into the nuclei of developing eggs, which become sexually differentiated and showWolanski's methyl-green reaction. The sex determination is, therefore, cytologically progamic and genotypical. The spawned eggs in the jelly strings appear first of identical shape and are all coated from the very beginning with grainy bonellian pigment, but afterwards, being reared in free water cultures in the (...) absence of females, they differentiate into distinctly different male and female larvae. The numerical ratio of the sexually differentiated larvae is discussed. The true chromosomes in gamogenesis as well as in somatic cells have not been found. There are two possible strategies for investigating questions on logic and mathematics. First, one can adopt the pattern recommended by the phenomenologists, which consists in looking for the actual essences of logic and mathematics in order to relate both fields. The second approach, adopted in this paper, starts with a historical review of the foundational standpoints. I will then try to extract on this base some insights on how logic and mathematics are mutually related. In particular, I am interested in (...) the concept of logic suggested by the development of the foundational debate. Yet one more preliminary remark is here in order. I will take into account the classical foundational positions: logicism, intuitionism, and formalism, as well as their later modifications and changes.1 Of course, this, so to speak, Foundational Trinity, does not exhaust the complete map of the foundations and philosophy of mathematics. For instance, I entirely neglect views wich might be exemplified by Lakatos, Dieudonné or Hersh, who, roughly speaking, radically deny that the study of logic and its relation to mathematics provides any interesting problem. I do not feel competent myself to judge this matter from the point of view of working mathematicians. On the other hand, philosophers are traditionally interested in the nature of logic and its links with other fields. Consequently, I regard my problem rather as a way of understanding what logic is, than whether it is important for mathematics or not. (shrink)

English summary: In this volume, Jan-Hendryk de Boer investigates the upheaval in the world of scholars in the Roman-German Empire at the end of the fifteenth and beginning of the sixteenth centuries. He shows how during this time hegemonic humanism developed as a new discursive formation. This re-organised the humanistic movement as well as its relationship to scholasticism and ultimately the place of humanism in the scholarly world as a whole. After humanistic ideas were initially taken on board as being (...) relatively unproblematic, the representatives of hegemonic humanism, such as poets, grammarians and philologists, claimed that they alone were in possession of useful skills and relevant knowledge. In a cultural transfer of the corresponding developments in Italy, a scholastic-humanist antagonism was generated that is still reflected in today's research. German description: Jan-Hendryk de Boer untersucht in dieser Studie den Umbruch in der Gelehrtenwelt des romisch-deutschen Reichs am Ende des 15. und zu Beginn des 16. Jahrhunderts. Er zeigt, wie sich in diesem Zeitraum der hegemoniale Humanismus als eine neue diskursive Formation ausbildete. Diese organisierte die humanistische Bewegung wie auch deren Verhaltnis zur Scholastik und schliesslich den Ort des Humanismus in der Gelehrtenwelt insgesamt um. Nachdem humanistische Ideen zunachst relativ problemlos Aufnahme gefunden hatten, beanspruchten die Vertreter des hegemonialen Humanismus als Dichter, Grammatiker und Philologen fur sich allein, uber nutzliche Fertigkeiten und relevantes Wissen zu verfugen.
